Terms of Service

Effective date: April 27, 2026

1. Acceptance of Terms

Welcome to PoolHQ. These Terms of Service (“Terms”) are a contract between you (or the company you represent) and PoolHQ. By creating an account, signing in, or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

If you’re using PoolHQ on behalf of a company, you confirm you have authority to bind that company to these Terms. In that case, “you” refers to the company.

2. The Service

PoolHQ is a software platform for pool service businesses. It includes a web app, mobile apps for technicians, a customer portal, and APIs. We add features, fix bugs, and make improvements continuously. We may change, suspend, or discontinue any part of the Service with reasonable notice for non-essential changes; emergency changes (security or stability) may happen without notice.

3. Account Registration

You need an account to use PoolHQ. You agree to provide accurate information, keep your login credentials secure, and notify us promptly if you suspect unauthorized access. You’re responsible for everything that happens under your account, including the actions of any team members or technicians you invite.

4. Pricing & Payment

PoolHQ is offered on monthly subscription plans:

  • Starter — $79/month. Up to 75 pools and 2 users.
  • Pro — $149/month. Up to 300 pools and unlimited users.
  • Scale — $299/month. Unlimited pools and unlimited users.

Subscriptions are billed in advance each month and auto-renew until you cancel. If you go over the pool limit on your plan, we’ll let you know and ask you to upgrade. We do not charge per-pool overage fees. All plans include full API access.

Payments are processed by Stripe. You authorize us to charge your card on file each billing cycle. If a payment fails, we’ll retry; if it continues to fail after 14 days, we may suspend your account.

You can cancel anytime from your billing settings. Cancellation takes effect at the end of the current billing period; we don’t prorate refunds for partial months.

Prices may change. We’ll give you at least 30 days’ notice before any price increase takes effect on your account.

5. Acceptable Use

You agree not to:

  • Use PoolHQ for anything illegal or that violates someone else’s rights.
  • Send spam, unsolicited marketing, or other communications that violate anti-spam laws.
  • Attempt to break, probe, or disrupt the Service or its security.
  • Reverse-engineer, decompile, or scrape the Service except as permitted by law.
  • Resell or sublicense access to the Service without our written permission.
  • Use the Service to build a competing product.
  • Upload malware, harassing content, or content that infringes intellectual property.

We may suspend or terminate accounts that violate these rules.

6. Customer Data — You Own It

The data you put into PoolHQ — customer records, photos, notes, chemical readings, invoices, and so on (“Customer Data”) — belongs to you. We don’t claim ownership of it. We use Customer Data only to provide the Service to you, to support you when you ask for help, and as described in our Privacy Policy.

You can export your data at any time. After you cancel, you have 90 days to retrieve it before we delete it.

You grant us the limited license to host, copy, transmit, and display Customer Data as necessary to deliver the Service. We may use aggregated, anonymized data (data that cannot be tied back to you or any individual) to improve our product.

7. Intellectual Property

PoolHQ, its software, designs, logos, and documentation are owned by us and protected by copyright, trademark, and other laws. We grant you a non-exclusive, non-transferable, revocable license to use the Service during your subscription, subject to these Terms. Nothing in these Terms transfers ownership of our intellectual property to you.

If you give us feedback or suggestions about the product, we may use it without obligation to you.

8. Termination

You can cancel your subscription at any time. We can suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates risk for us or other users. We’ll give you reasonable notice when we can.

After termination, sections that should survive (Customer Data ownership, IP, disclaimers, limitation of liability, governing law) remain in effect.

9. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee the Service will be uninterrupted, error-free, or perfectly accurate. Pool chemistry recommendations are guidance based on the data you provide and accepted industry formulas; you and your technicians remain responsible for the safety and quality of service delivered.

10. Limitation of Liability

To the maximum extent permitted by law, PoolHQ’s total liability to you for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption, even if we’ve been advised of the possibility.

Some jurisdictions don’t allow these limits, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold PoolHQ harmless from claims, losses, and expenses (including reasonable attorney’s fees) arising out of your use of the Service, your violation of these Terms, or your violation of someone else’s rights.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Florida, and you consent to that jurisdiction.

13. Changes to These Terms

We may update these Terms occasionally. If we make material changes, we’ll notify you by email or in-app at least 30 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. The current version is always available at /terms.

14. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and PoolHQ. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of the right to enforce it later. You can’t assign these Terms without our written consent; we can assign them as part of a merger, acquisition, or corporate reorganization.
